Article 1: Preamble
Connexion TIP is a declared independent training organisation. Its head office is located at 2 rue de la Tour, 92190 Meudon, France. It is declared under the activity declaration number 11921777992 and is hereinafter referred to as «the training organisation».
This Internal Regulation aims to clarify certain provisions applicable to all registered participants attending the various training courses organised by Connexion TIP, in order to ensure the smooth running of the proposed training.
Article 2: General Provisions
In accordance with Articles L. 920-50-1 et seq. and R. 922-1 et seq. of the Labour Code, the purpose of these internal regulations is to define the general and permanent rules and to specify the regulations concerning hygiene and safety, as well as the rules relating to discipline, in particular the sanctions applicable to trainees and their rights in the event of a sanction.
Article 3: Scope of application
Applicability: This Regulation applies to all trainees enrolled in a session provided by Connexion TIP for the entire duration of their training. Each trainee is considered to have accepted the terms of this Regulation by attending a training session provided by Connexion TIP and agrees that measures may be taken against them for non-compliance.»
Location of the training: The training takes place either on a digital platform (ZOOM or TEAMS or other), at the client’s premises, or (most often) in external premises. The provisions of these Regulations apply not only within theConnexion TIP premises but also in any premises intended for training.
Article 4: Hygiene and Safety
Each intern must also ensure that they comply with the rules regarding their personal safety and that of other individuals, as in force at the establishment where training is provided by Connexion TIP.
When training takes place in a company or establishment already having internal regulations, the safety and hygiene measures applicable to trainees are those of the latter regulations, in accordance with Article R. 922-1 of the Labour Code.
Article 5: Alcohol and others
In accordance with Decree No. 2006-1386 of 15 November 2006 laying down the conditions for the application of the smoking ban in places intended for collective use, smoking is prohibited in training premises, except in areas designated for this purpose.
Interns are forbidden from bringing alcoholic beverages onto the training premises. Furthermore, it is forbidden to enter the training premises while intoxicated.
Trainees are also forbidden, unless they have special permission, from having their meals in the rooms where the traineeships are organised.
Article 6: Fire Regulations
In accordance with Articles R. 232-12-17 and following of the Labour Code, fire safety instructions, including a map showing the location of fire extinguishers and emergency exits, are displayed in the training premises so that all trainees are aware of them.
Article 7: Accident
Any accident or incident occurring during or in the course of training must be immediately reported by the injured trainee or witnesses of the accident to the organisation's manager.
In accordance with Article R.962-1 of the Labour Code, any accident that occurs to a trainee while they are at the training location, or while travelling to or from it, must be reported by the head of the organisation to the social security fund.
Article 8: Dress and behaviour
Trainees are requested to present themselves at the training venue in decent attire and to behave appropriately towards everyone present in the organisation.
Article 9: Internship Hours
The internship schedules are set by Connexion TIP or the «ordering» company and communicated to the trainees either by an electronic summons or when the training programme is handed out. Trainees are required to adhere to these schedules. Connexion TIP reserves the right, within the limits imposed by current regulations, to modify internship schedules according to operational requirements. Trainees are required to adhere to these schedules. In the event of absence or lateness for the internship, it is preferable for the trainee to notify either the trainer, the person in charge of the training organisation, or the «ordering» party.
Trainees are required to sign a register every day for the duration of the training (or at the end of the training when it's via a digital platform).
Article 10: Access to the training location
Unless expressly authorised by Connexion TIP, trainees with access to the training venue for the purpose of attending their training may not facilitate the introduction of third parties to the organisation.
Article 11: Use of Equipment
Each intern is obliged to keep in good condition the equipment entrusted to them for their training and to use it in accordance with its purpose. The use of equipment for other purposes, particularly personal ones, is prohibited, except for equipment made available for this purpose. At the end of the internship, the intern is required to return all equipment and documents in their possession belonging to the training organisation, with the exception of educational documents distributed during the training.
It is strictly forbidden, unless expressly authorised, to record or film training sessions.
The teaching materials provided during training courses are protected by copyright. Their reproduction, without the authorisation of the training organisation, is strictly prohibited. These materials may only be reused for personal purposes.
Article 12: Training provider's liability
Connexion TIP declines all responsibility for the loss, theft or damage of personal belongings of any kind brought by trainees to the training location.
Article 13: Respect of trainee data confidentiality
Any intern at Connexion TIP or employee of the training organisation undertakes to keep confidential all personal and professional information about the trainees that comes to their attention.
Article 14: Sanctions
Any breach by the intern of any of the provisions of these internal regulations may be subject to disciplinary action.
A sanction, within the meaning of Article R. 922-3 of the Labour Code, is any measure, other than verbal observations, taken by the director of the training organisation or their representative, following an act by the intern considered by them to be faulty, whether or not this measure is likely to **immediately** affect the intern's presence on the internship or to call into question the continuity of the training they are receiving.
Fines or other pecuniary penalties are prohibited.
Depending on the seriousness of the misconduct, the sanction may consist of either a warning, a reprimand, or a measure of permanent exclusion.
The head of the organisation must report the sanction taken:
- The employer, when the intern is an employee benefiting from a training course as part of a company's training plan; ;
- The employer and the joint body that bore the training costs, where the trainee is an employee benefiting from a training course within the framework of a training leave; ;
- The organisation that financed the training course the trainee benefited from.
Article 15: Disciplinary proceedings
No sanction may be imposed on the intern without them having been previously informed of the grievances against them.
When the training provider's manager or their representative intends to take a disciplinary action that has an impact, immediate or otherwise, on a trainee's attendance on a course, the following procedure shall be followed:
- The head of the training organisation or their representative summons the trainee, stating the purpose of the summons. This specifies the date, time, and place of the interview. It must be in writing and sent by recorded delivery or handed to the person concerned against a receipt.
- During the interview, the intern may be assisted by a person of their choice (intern or employee of the training organisation). The aforementioned summons states this right.
- The head of the training organisation, or their representative, shall state the reason for the intended sanction and gather the trainee's explanations.
- In cases where permanent exclusion from training is being considered and there is a continuous improvement committee, a disciplinary board shall be convened, which shall include trainee representatives. It shall be convened by the head of the training organisation or their representative after the aforementioned interview and shall issue an opinion on the proposed exclusion measure. The trainee shall be notified of this referral. They shall be heard at their request by the disciplinary board. They may be assisted by a person of their choice, either a trainee or an employee of the training organisation, within one clear day after its meeting.
- The sanction cannot be imposed less than one clear day, nor more than fifteen days after the interview, or where applicable, after the transmission of the disciplinary committee's opinion. It shall be subject to a written and reasoned decision, notified to the trainee in the form of a letter handed over to them against receipt or a registered letter. When the misconduct has led to a provisional measure of temporary exclusion with immediate effect, no final sanction relating to this misconduct may be taken without the trainee having been previously informed of the charges against them and, where applicable, without the procedure described above having been followed.
Various dispositions
At the end of each training course, trainees are given a training assessment form, which they must complete and return to the trainer. A certificate of completion will then be issued to the trainees.
Article 16: Entry into force
A copy of these regulations is available at Connexion TIP's premises, on its website (www.connexiontip.com), and is included in the training materials provided to participants.
This Regulation shall enter into force on 1 October 2017.
